LENNAR SAN ANTONIO GREAT REALTOR RACE CONTEST OFFICIAL RULES No Purchase Necessary to Enter or Win. Purchase will not increase your chances of winning. This Contest is sponsored by Lennar Homes of Texas Sales & Marketing, Ltd., 1922 Dry Creek Way, Suite 101, San Antonio, TX 78259 ("Sponsor" or “Lennar”). Contest is governed by these official rules (the “Official Rules”). By participating, each participant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. These Official Rules are the complete statement of the terms and conditions of the Contest. Participants may not rely on any oral representation regarding the Official Rules (including, without limitation, by Lennar, its agents or representatives), including statements concerning interpretation or enforcement of the Official Rules. Any questions of a potential violation of the Official Rules or dispute concerning their interpretation will be decided by Sponsor in its sole and absolute discretion. By participating, each participant agrees to the official rules. Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law. Eligibility. Contest is open only to teams of real estate professionals that are licensed to practice in the state of Texas who are (1) 18 years of age or older; (2) employed or otherwise associated with an active real estate broker licensed to do business in Texas (“Event”). Employees, officers and directors of Sponsor, UAMC, Larry John Wright, Inc., The Zimmerman Agency, and Sponsor’s vendors, agents, consultants, and their respective immediate family members (defined as parents, spouses, children, siblings and grandparents) and persons living in the same household are not eligible to win. Sponsor reserves the right to verify eligibility. BY ENTERING, EACH PARTICIPANT REPRESENTS THAT HE OR SHE IS ELIGIBLE TO PARTICIPATE IN THE CONTEST, HAS OBTAINED ANY REQUIRED PERMISSION FROM ANY NECESSARY PARTIES TO PARTICIPATE IN THE CONTEST AND ACCEPT ANY PRIZE AWARD, AND PARTICIPATION IN THIS CONTEST AND ACCEPTANCE OF A PRIZE DOES NOT VIOLATE ANY AGREEMENTS OR OBLIGATIONS HE OR SHE MAY HAVE WITH HIS/HER EMPLOYER OR ANY THIRD PARTY OR ANY APPLICABLE LAWS OR ASSOCIATION RULES OR REGULATIONS APPLICABLE TO THE PARTICIPANT. Participants understand that prize awards may be distributed to the broker of the real estate professionals entering this Contest, as required by applicable law or individual brokerage rules. How To Participate. Register a team of three eligible participants with Sponsor by completeing registration at https://www.raceentry.com/race-reviews/great-race-2018 . The first thirty teams to register will compete. Team must include participants from the same office. Each participant will be required to execute a Release, Hold Harmless and Indemnity Agreement prior to participation in the Contest to be eligible to participate. Each team participant must have a valid driver’s license and show proof of auto insurance and wear appropriate attire for participation in the Contest. Each team of participants must travel in the same vehicle. Sponsor reserves the right to limit the number of participating teams for the Contest. Contest will be conducted on September 1st, 2018 beginning at or about 9:00 am CT and concluding at or about 3:00 pm CT (“Contest Period”) and will begin and end at the Welcome Home Center at Village Builders Sonoma Mesa community. Contest requires a visit to and check-in on Facebook at the following four (4) participating Lennar communities (each a “participating community”) to be eligible: Balcones Elm Valley Mission Del Lago Heather Glen The Crossings Each team must complete the following activity at each participating community to be eligible for the Grand Prize: Take a team picture in front of the WHC monument at each participating community and post the photo and check-in at the participating community on Facebook. The grand prize winner will be determined as provided under the Winner Selection section below. Participants must comply with all road and traffic laws and regulations during the duration of the Contest. Any participant or team that is determined to have violated any law or regulation or competed in a manner that endangered the health or safety of any participant or the public will be immediately disqualified. The rules for the competition and tie-breaker will be provided at the time of participation and all participants must comply with the rules or may be disqualified by Sponsor, as Sponsor’s sole discretion. Prizes. One Grand Prize: Grand Prize is exposure for members of the winning team on a billboard selected by Lennar San Antonio that will begin on a day after conclusion of the Contest as determined by Lennar and will run for approximately three (3) months thereafter (ARV: $9000). Delivery and commencement of the billboard exposure is dependent on receipt of all required information from the prize winner (including without limitation logos, name, contact information, releases, etc.). Sponsor makes no warranties, representations or guarantees relative to the prize, and disclaims all liability for the provision, use, quality or nature of any third party product or service provided to the prize winner. The billboard exposure is not a promise or representation of results in increased business or a more profitable business. PARTICIPATION PRIZES: Various Prizes (selected by Sponsor) will be distributed based on challenges announced day-of the event. One Thousand Twenty (1020) stress balls numbered 1-1020 will be dispersed at the welcome home centers at each Lennar and Village Builders community (both participating and non-required communities) in the greater San Antonio area. Thirty-four (34) gold stress balls (one at each community) and nine-hundred eighty six (986) regular stress balls. Team participants that locate the stress balls must bring them to the Johnson Ranch community prior to the end of the Contest Period to see if the number on the ball corresponds to a prize. Not all stress balls will qualify for a prize. Prize for winning gold stress ball is $150 to be evenly divided between team participants. Prize for randomly slected winning regular stress balls will be selected by Sponsor. Sponsor makes no warranties, representations or guarantees relative to any prize, and disclaims all liability for the provision, use, quality or nature of any product or service provided to the winners. Prize winner is responsible for all taxes resulting from acceptance and use of the prize, and all costs and expenses not specified as part of the prize. Winner Selection. The team that visits and checks-in at the four participating communities, plus the most Lennar or Village Builders communities (both participating communities and non-required communities) in the greater San Antonio area during the Contest Period (as measured by Sponsor) will be the Grand Prize Winner. There are thirty-four (34) total community locations eligible for check-in. If more than one team qualifies as the grand prize winner by visiting and checking-in at the most Lennar communities, Sponsor will determine the winner in accordance with the tie-breaker process announced at the start of the event. Potential grand prize winning team will be notified by phone call and e-mail following verification. Potential winners of the participation prizes will be determined by Sponsor and notified at the event. Upon the request of Sponsor, the potential winners will be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 forms, as applicable. If a potential winner fails to comply with these official rules, that potential winner will be disqualified and an alternative prize winner may be selected, time permitting. No more than the stated number of prizes will be awarded. Prizes may not be awarded if an insufficient number of eligible participants participate. Additional Limitations. Prizes are non-transferable. No substitution or cash equivalent is permitted, except in Sponsor’s sole discretion. Sponsor reserves the right to award a prize of equal or greater value in the event a prize is unavailable. Winner is not entitled to the difference between the approximate retail value and the actual value of any prize. Sponsor and its affiliates are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in the printing or posting of the offer or official rules, the selection and announcement of any winner, or the distribution of any prize. Sponsor reserves the right to terminate, withdraw or amend the Contest or disqualify any entry for any reason and without notice including, without limitation, if the Contest cannot be administered as planned or if Sponsor suspects tampering has occurred. limitation of liability. BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS LENNAR AND ITS RESPECTIVE PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES) WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), CONTRACT, WARRANTY, STRICT LIABILITY, RELIANCE OR UNDER ANY OTHER THEORY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT PARTICIPANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON, AND WHETHER OR NOT LENNAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LENNAR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. publicity. By participating, each participant grants Sponsor permission to use his/her name, likeness, or comments for publicity purposes (including, without limitation, posting of the check-in photos on Lennar social media) without payment of additional consideration, except where prohibited by law. Intellectual Property. The Contest official rules and all related promotional content are the property of Lennar or authorized third parties. The copying or unauthorized use of any of those materials, associated trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited. Dispute Resolution. Participants agree that: (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Contest or the acceptance, use or misuse of the prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court in the Western District of Texas, San Antonio Division, or the appropriate Texas state court located in Collin County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs, but in no event including attorneys' fees, disbursements or court costs; (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than for actual out-of-pocket costs; and (4) any right to a jury trial in any dispute, claim, or cause of action arising out of, or connected with, this Contest is hereby waived. copies of the rules and who won.
