Bryce Canyon Half & 5k Waiver
I know that running is a potentially hazardous activity. I should not enter and run unless I am medically able and properly trained. I agree to abide by any decision of a race official relative to my ability to safely complete the run. I hereby certify that I am in good health and I have trained to run the distance of the race, which I am entering. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, including high heat and/or humidity, traffic and the conditions of the road, all such risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of your accepting my entry into this running race, I, for myself and anyone entitled to act on my behalf, waive and release the Bryce Canyon Half & 5k and Bryce Community Foundation, Inc., its officers, directors, agents, volunteers and employees, all states, cities, counties, or other governmental bodies or locations in which events or segments of events are held, all sponsors, their representatives and successors, from all claims or liabilities of any kind arising out of my participation in this event even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. I grant permission to all of the foregoing to use any photographs, motion pictures, recordings, or any other record of this event for any legitimate purpose. I understand that bicycles, skateboards, roller skates or inline skates and animals are not allowed in the event and I will abide by this policy. I also understand that baby joggers are discouraged for the safety of all participants. I authorize any healthcare provider to release any and all information pertaining to my healthcare, medical condition and medical treatment as a result of my participation in this event to the Bryce Canyon Half & 5k and Bryce Community Foundation, Inc. and its staff and volunteers.
I understand an entry is non-refundable and there is a transfer and defer deadline posted on the website, after which I will not be able to defer or transfer my entry. I also acknowledge that bibs are limited, they need to be picked up by the selected time or they are forfeited and able to be resold.
Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
Bryce Community Foundation & Bryce Canyon Half Marathon & 5k cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s services or premises. It is not possible to prevent the presence of the disease. Therefore, if you choose to utilize Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s services and/or enter onto Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s services and enter Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s premises. These services are of such value to me Bryce Community Foundation & Bryce Canyon Half Marathon & 5k [and/or to my children and extended spectator party] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s services and premises in person.
WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Bryce Community Foundation & Bryce Canyon Half Marathon & 5k and its owners, officers, directors, managers, officials, trustees, agents, employees, volunteers or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Bryce Community Foundation & Bryce Canyon Half Marathon & 5k’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
CHOICE OF LAW: I understand and agree that the law of the State of Utah will apply to this contract.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
I am the parent or legal guardian of the minor named above. I have the legal right to consent to and, by signing below, I hereby do consent to the terms and conditions of this Release.
