Read this waiver carefully. It includes a release of liability and waiver of legal rights and deprives you of the ability to sue certain parties. Do not agree to this document unless you have read and understood it in its entirety. By agreeing electronically or by signing, you acknowledge
that you have both read and understood the text presented to you as part of the registration process. You also understand and agree that
events carry certain inherent dangers and risks which may or may not be readily foreseeable, including without limitation personal injury,
property damage or death. Your ability to participate in the event is subject to your agreement to the waiver and by agreeing herein, you accept
and agree to the terms of the waiver and release agreement.
I certify that I am physically fit, have sufficiently trained and prepared for participation in this event and have not been advised otherwise by a
qualified medical person. I acknowledge that this athletic event is an extreme test of a person’s physical and mental limits and carries with it the
potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature,
weather, lighting conditions, condition of athletes, lack of hydration, equipment, vehicular traffic, actions of other people including, but not
limited to, participants, volunteers, spectators, journalists, event officials, event monitors, and/or producers of the event. The risks are not only
inherent to athletics but are also present for volunteers and support staff. I hereby assume all of the risks of participating and/or volunteering in this event called Iron Lung Ride held on July 19, 2025.
I know that bike riding and/or driving, regardless of the distance, is a potentially hazardous activity, and that I should not enter and participate
unless I am medically able and properly trained. I agreed to abide by any decision of a race official relative to my ability to safely complete this
road race and I further agree that race officials may authorize necessary emergency treatment for me. I also understand that police protection
may not be provided, and both vehicle traffic and spectators may be present along the course. I assume the risk of riding and/or driving under
such conditions, and I further assume any and all other risks associated with participating in the Iron Lung event including, but not limited
to illness, traveling to and from the event, falls, contact with spectators or other participants, the effects of weather (including temperature
extremes, humidity, dark or light conditions), and the surface conditions of the roads, all such risks being known and appreciated by me. As a
condition of my participation, I further agree to abide by all traffic and pedestrian laws and regulations, and understand that my failure to do so
may be grounds for disqualification from the event.
In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators,
heirs, next of kin, successors, or anyone else whom might claim on my behalf, covenant not to sue, and waive, release and discharge the founder, Michelle Lyman, Iron Lung Ride race officials, volunteers, and any and other sponsors, suppliers, agents, independent contracts, employees and other personnel in any way assisting or connected with this event from any and all claims and any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this event or any other liability of any kind or nature whatsoever arising out of my participation in this event, even though such liability may arise out of negligence or carelessness on the part of the persons or entities named in this waiver.
Each of us individually (and/or as parent and/or guardian of the named minor) do hereby release, remise, waive and forever discharge the State
of Utah, Weber County, Morgan County, Salt Lake County, Salt Lake City, This Is The Place Heritage Park, the Utah Department of Transportation, the Utah Transportation Commission, the Utah Highway Patrol, and their officers, agents, and employees of all the above mentioned entities from all liability, claims, demands, actions or causes of action whatsoever arising out of or related to loss or damages and/or injuries, including death, which may result from my participation in the Iron Lung event on July 19, 2025, involving roads within the Utah State Highway system.
UDOT WAIVER AND RELEASE OF DAMAGES AGAINST THE STATE OF UTAH FOR PARTICIPATION IN AN APPROVED SPECIAL EVENT ON STATE ROADS - Each of us individually (and/or as parent and/or guardian of the named minor) do hereby release, remise, waive and forever discharge the State of Utah, the Utah Department of Transportation, the Utah Transportation Commission, the Utah Highway Patrol, and their officers, agents, and employees from all liability, claims, demands, actions or causes of action whatsoever arising out of or related to loss, or damages and/or injuries, including death, which may result from my participation in the Iron Lung bike event, involving roads within the Utah State Highway system.
I hereby authorize Iron Lung Ride to use my image or likeness for race promotional purposes. I understand that race registration fees are
nonrefundable. I certify that I have read this document and I understand its content.
