RELEASE, INDEMNIFICATION & HOLD HARMLESS
The race participant recognizes and acknowledges that there are certain inherent hazards and risks connected with participation in City activities and programs. Some of these risks of participation in the City organized race series include but are not limited to, uneven terrain, inclement weather conditions, motorists, other racers, risks of tripping or falling, medical complications associated with exercise or a myriad of other known or unknown hazards. The race participant hereby knowingly and voluntarily assumes full responsibility for such risks and hazards whether known or unknown. The race participant is aware of the content of the program or activity they choose to participate in and represent that they are physically, mentally and emotionally fit and capable of safely participating in such programs or activities. The race participant agrees as a condition of participation in programs or activities to release, defend, indemnify and hold harmless South Jordan City, its officers, agents, employees and volunteers from and against any and all loss, judgments, damage and expense incurred by reason of any claim or liability based upon (1) personal injury (including death) or property damage to any person arising out of the negligent or intentional action of the race participant, or (2) personal injury (including death) or property damage to the race participant, except to the extent that such injury or damage is directly caused by the negligent acts or omissions of South Jordan City, its officers, agents, employees or volunteers.
RACE ENTRY DEFERRAL OR TRANSFER, PUBLICITY RIGHTS
Entry Fees for Race Series events are non-refundable. Entries may be deferred to another open Race Series race for an additional three dollars ($3.00) plus the online fee and marketplace tax up to five days prior to the scheduled race. Transfers to other participants are allowed up to three days prior to the scheduled race with no transfer fee.
Runners agree to the use of his/her name and photograph in broadcasts, newspapers, brochures, and other marketing mediums without advance notice or compensation.
PRIVACY POLICY
For the purposes of this registration, “personally identifiable information” means any information relating to an identified or identifiable individual who is the subject of the information. Any personally identifiable information that the City of South Jordan (the “City”) received to facilitate your registration is handled as it would be on an in-person visit to the City’s offices. Your personally identifiable information will be used by the City, its entities, and third-party agents with whom it has contracted to perform a City function or service. The City is subject to certain disclosure requirements of the public records it maintains under the Utah Government Records Access and Management Act. The City may also be subject to other sections of the Utah Code and other federal laws. The City is committed to data security of personally identifiable information that is collected during your registration. The City takes reasonable precautions to protect personally identifiable information, not subject to disclosure by applicable law, from loss, misuse or alteration. However, data transmissions over the internet cannot be guaranteed to be 100% secure. By submitting personally identifiable information you understand that the City, its entities, or its third party agents may use information like your email to send you emergency information or other important notices. The City, however, does not disclose, sell, trade, or rent your personally identifiable information to outside parties.
