THE SNAKE-RUN RALLY WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
1. In consideration of being permitted to use/snowboard on the Snake Run Rally course, on April 12th and 13th, 2025, I hereby release, waive, discharge and covenant not to sue GRASSROOTS COLLECTIVE LLC DBA THE SNAKE-RUN RALLY., their officers, servants, agents and employees (hereinafter referred to as "Releases") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of, or relating to, any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Releases, or otherwise, while using a snowboard, or while in, on or upon the premises of HOODOO SKI AREA.
2. I understand that snowboarding can be hazardous and that injuries are common when participating in such activities. I hereby elect to voluntarily participate in this activity knowing that conditions may be hazardous, or may become hazardous or dangerous to me or my property. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, as a result of my participating in snowboarding, whether caused by the negligence of Releasees or otherwise, including, but not limited to, changing weather conditions, variations and steepness in terrain, terrain features and parks, snow or ice conditions, surface or subsurface conditions, bare spots, creeks and gullies, forest growth, rocks, stumps, course design and placement, terrain feature design and placement, the use of lifts, collisions with natural or man make objects or other persons, grooming and snowmobile equipment, lift towers and other structures and their components, falling, loss of control, and exceeding one’s ability.
3. It is my express intent that this Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a Release, Waiver, Discharge and Covenant Not to Sue the above named Releases.
4. If signing on behalf of a minor participant, I, as parent/guardian, accept full responsibility for any medical expenses incurred due to the minor’s participation in snowboarding, and agree to release, hold harmless, and indemnify (including costs and attorney’s fees) the Releases for any claims brought by, or on behalf of, the minor.
In signing this release, I acknowledge and represent that:
A. I have read the foregoing release, understand it, and sign it voluntarily as my own free act and deed;
B. No oral representation, statements or inducements, apart from the foregoing written agreement, have been made;
C. Except in the case of a minor who must also have a parent or legal guardian sign, I am at least eighteen (18) years of age and fully competent; and
D. I execute this Agreement for full, adequate and complete consideration, fully intending to be bound by same.
